Date set for Hyatt murder trial
It will be another 10 months before the family of slain teenager Ashlee Hyatt learns if her accused killer will be put behind bars.
A West Kelowna teenaged girl is accused of murdering Hyatt at a Peachland house party in the summer of 2010. She cannot be named under the Youth Criminal Justice Act.
A trial date of October 15, 2012 has been set for the accused, who allegedly stabbed 16-year-old Hyatt at a house on San Clemente Avenue.
“Ten more months to wait for justice for my beautiful daughter,” Hyatt’s mother Charrie Hyatt-Griswald told Peachland News. “I have waited this long, by the time this goes to trial we have waited two years and four months, so ridiculous.
“At least the trial has been set and we are getting closer to justice,” said Hyatt-Griswald.

Hyatt’s accused murderer going to trial
A 17-year-old West Kelowna girl will stand trial for the murder of 16-year-old Ashlee Hyatt.
The order came down after a six-day preliminary hearing in Kelowna.
Hyatt was fatally stabbed at a house party on San Clemente Avenue in Peachland in June, 2010. The accused killer was initially charged with first degree murder but the charge was changed to second degree murder.
The accused, who was 16-years-old at the time of the murder, will face a trial by judge and jury. She faces an adult sentence if convicted.
The trial date will be set on Monday. The accused is out on bail under restrictions.

Prelim. hearing for Hyatt murder case
Up to seven days has been set aside for the preliminary hearing for the accused murderer of a 16-year-old West Kelowna girl.
Ashlee Hyatt was murdered at a house party on San Clemente Avenue in Peachland on June 2, 2010. The preliminary hearing starts Monday for the accused, a female who was 16 at the time of the murder.
Her death shocked the community and classmates at Mount Boucherie Senior Secondary School.
The accused, who cannot be named, faces a preliminary hearing at the Kelowna Courthouse. A courtroom has been set aside for the hearing from 9:30 a.m. to 4:30 p.m., from October 3 to 7. A further two days, October 12 and 13, have been set aside, should they be required.
“We are one step closer to justice for Ashlee after these hearings,” said Ashlee’s mother Charrie.
Peachland has become the focal point for remembering Hyatt. In January, a memorial bench was placed near the yacht club, on Centennial Way. It has since become a regular gathering place for family and friends.
On the one year anniversary of Hyatt’s death, supporters gathered at Swim Bay to remember. Fireworks were set off in honour of Hyatt.

Swim Bay fireworks in memory of Ashlee Hyatt
About 200 people, mostly teens, turned out Thursday night to honour the memory of murdered teenager Ashlee Hyatt on the one year anniversary of her death. A short fireworks display at Swim Bay capped off an evening of remembrance.
Fireworks planned to mark teen’s ‘Angelversary’
Fireworks will be set off in Peachland early next month to mark the solemn anniversary of a murder one year ago.
Ashlee Hyatt was just 16-years-old when she died on June 2, 2010. She was at a house party on San Clemente Avenue.
Little can be published about the events of that day due to a court ordered publication ban, but it is known that Ashlee’s accused murdered is a 16-year-old female from West Kelowna.
On June 2 of this year, Charrie Hyatt, along with friends and family, will be in Peachland to remember Ashlee and her young life lost.
“There will be 25 fireworks set off in memory of Ashlee for her one year Angelversary,” said Charrie Hyatt.
Working with Peachland Fire and Rescue Service, Hyatt received permission to set off fireworks on the one year anniversary of her daughter’s death.
“The apparently have flowers in them and I want her to get those in heaven,” said Hyatt.
The fireworks display will only last about five minutes, but Hyatt said, “I know it will be beautiful. I just wanted to celebrate her.”
Hyatt said the fireworks will be set off near the Swim Bay Dock shortly after 10 p.m.
Hyatt will be at Mount Boucherie Senior Secondary School on June 7 to award The Ashlee Hyatt Memorial Bursary. The bursary amount for this year’s inaugural presentation will be $2,000, according to Hyatt, because Ashlee would have graduated this year.

Murdered teen’s memorial bench becomes gathering place
It was an atypical January day Sunday. The brightness and warmth of the sun brought hundreds of casual strollers to Centennial Way. Some people jogged, a few slid on Rollerblades, most ambled along, enjoying the solar powered day.
Benches along the walk were taken up by people enjoying the unusual display of Okanagan sun, mid-winter. One bench became the focal point for a small group, there to celebrate and remember.
(Samantha Waller and Charrie Hyatt sit on
a memorial bench dedicated to Ashlee Hyatt.)
A cluster of balloons danced in a gentle breeze and if some passersby thought a beach in January an odd place for a birthday, one look at the plaques on the bench would have told the tale.
Samantha Waller celebrated part of her 19th birthday on that bench, on Centennial Way, on Peachland’s waterfront. She could have been anywhere else, but she wanted to connect with one of her best friends and the bench was the perfect place to do so.
The friend will never sit on the bench, even though the bench exists in her honour. The friend is Ashlee Hyatt and she was murdered.
Charrie Hyatt, Ashlee’s mother, said she felt a memorial for her daughter should be in the place where she died.
“One of her friends looked into it for me,” said Hyatt.
The friend learned that, under District of Peachland rules, the entire bench and the cost of any memorial plaques must be purchased. That meant a bill of between $2,500 and $3,500.
“I put it on Facebook,” said Charrie, who was already in the midst of coordinating a bursary in memory of Ashlee.
The parents of Nicole Gray offered to pay for the bench. Plaques were ordered and, one week ago, they were installed.
“It was pretty emotional,” Charrie said, talking about her visit to the bench.
Charrie said the bench is a place to visit; a place for her, her family and Ashlee’s friends to connect.
Ashlee and her group of friends often spent time at Swim Bay and Charrie said it’s nice that the bench is so close to where the kids went swimming on hot summer days.
“There’s a picnic table there, so we can have lunch with her,” said Charrie.
Although she wanted the memorial bench close to where Ashlee was murdered, Charrie said she didn’t realize until recently just how close it was.
Charrie said she always takes the same route to Beach Avenue from her home in West Kelowna, down Hwy. 97, left on 13th Street, then right onto Beach. Only recently did she see the sign for San Clemente Avenue.
Not a block down that road, on June 2, 2010, 16-year-old Ashlee Hyatt was murdered. Something terribly wrong happened that night at a house party. Few details are known and fewer still can be reported because of a publication ban.
What is known is that Ashlee’s accused murdered is female and was also 16 when Ashlee died.
For her part, Charrie said she couldn’t and can’t drive down San Clemente Avenue. “I refused to know.”
She said she did pretty good handling the death of her daughter until the day the accused murderer had her bail conditions relaxed so that she could leave her home under adult supervision. That’s when Charrie went on medical leave.
Ashlee Hyatt would have graduated this spring. One graduate that attended the Peer Mentoring Program (a program Ashlee took in Grade 10) at Mount Boucherie Senior Secondary School will receive a $2,000 bursary. In subsequent years, $1,000 bursaries will be handed out.
The bursary fund has $6,000 in it already, according to Charrie, who called the community “amazing” in rallying behind the scholarship idea.
A six-hour car wash in August raised $2,500. Ashlee’s friends held a bake sale at Mount Boo, raising $900 in the process.
“I know we have a big trek ahead of us,” said Charrie, adding that a preliminary hearing for the accused will be held in October.
In the mean time, Charrie and Ashlee’s friends will have a special place in Peachland to remember Ashlee. And when they look at the plaques embedded in the memorial bench, they’ll read:
In loving memory of Ashlee Delore Hyatt, loving daughter, sister, cousin, niece and friend.

Donations can be made by cheque to C.O.B.S.S. and donators should write Ashlee Hyatt Memorial Bursary in the cheque’s memo section. Updated: Charge for Hyatt’s murder reduced
Update. . . The mother of slain teenager Ashlee Hyatt believes the reason her daughter’s accused murderer is now facing a lesser charge is because of the complexity of the legal system.
The accused chose to be tried in the case by judge and jury and that may have had an effect on the Crown prosecutor’s decision, according to Charrie Hyatt.
“A jury only gets the charge presented to them. They cannot waver that charge, so if they did not find her guilty of first degree murder as an adult, she (the accused) would walk away,” said Hyatt. “That is why I believe they dropped the charges to second degree murder as an adult and added a charge of aggravated assault with a deadly weapon also.”
A preliminary hearing for the accused is scheduled to begin October 3, 2011 and last for six days. A charge of aggravated assault with a deadly weapon was added because the accused murderer also allegedly attacked another teen the night Ashlee was murdered.

Hyatt accused murderer appears in court
The accused teen murderer of 16-year-old Ashlee Hyatt appeared in court Tuesday, where it was disclosed that a preliminary hearing could last up to two weeks.
The defendant, also 16, is accused of first degree murder and assault with a weapon. Before a preliminary hearing can take place, the accused must decide if she wants to be tried by a jury or a judge alone. A tentative date of September 21 has been entered for the accused to tell the court which way she wishes to be tried. The accused teen cannot be identified because of her age. She was arrested after Hyatt was fatally stabbed at a house party on San Clemente Avenue in Peachland. She is also accused of trying to stab a 17-year-old at the party. Currently on bail with a 24-hour curfew, the accused is barred from weapons, consuming drugs or alcohol and using Internet-based social media.

Hyatt’s friends start anti-bail petition
Friends of slain teenager Ashlee Hyatt are organizing a petition against bail given to her alleged killer, AM1150 is reporting today.
Hyatt died from stab wounds received at a Peachland house party several weeks ago. Her alleged assailant was released on $10,000 bail last week pending her trial.
The petition will be available at the corner of Main Street and Brown Road Sunday, June 13, from 10 a.m. to 10 p.m.

Facebook battleground over teen’s death
While the accused murderer of 16-year-old Ashlee Hyatt has been banned from using all social networking mediums on the Internet, a disturbing battle is taking place on Facebook.
Within hours of Hyatt’s death last Wednesday evening, a memorial page was set up on Facebook. And almost as fast, some users began posting some nasty comments. A day later, extra controls were put in place on the memorial page, which also limited non-member access.
Now, other Facebook pages related to the murdered teen are popping up, and some of the posts on them are shocking.
Editor’s note: Peachland News will not post the address of the Facebook pages in question. We ask that commenters also not include addresses or page names in comments, as those comments will not be published.

Murder suspect faces charge of first degree murder, assault with a weapon
A 16-year-old female student accused in the stabbing death of another student at a Peachland house party Wednesday night is facing a charge of first degree murder.
The accused and the victim, both 16, attended Mount Boucherie Senior Secondary School and both were residents of West Kelowna.
RCMP confirmed unsubstantiated reports circulating after the Wednesday night murder that a second female victim was involved.
The female suspect appeared in Kelowna court Friday to hear charges of first degree murder and assualt with a weapon. The second charge relates to the second victim, a 17-year-old female who is believe to be from Peachland.
The 17-year-old victim was apparently involved in an altercation with the suspect immediately following the fatal stabbing, according to Cnst. Steve Holmes. The second victim did receive injuries but they are not considered serious.
Holmes said the accused was involved in a “verbal altercation” with the murder victim prior to the fatal stabbing.
The weapon that was used in both incidents has been recovered by police, according to Holmes.
All three girls were at a house party on San Clemente Avenue when the incidents occurred. All three apparently knew each other.

SD 23 urges victim’s friends to seek help
School district officials brought in a critical incident response team Thursday morning to Mount Boucherie Senior Secondary School to help students deal with the stabbing death of oner of their classmates.
A 16-year-old West Kelowna female was murdered at a house party on San Clemente Avenue Wednesday night.
“It is important that we focus on supporting each other at this time,” states an email sent out to MBSS parents.
“This tragic news may be very hard for you or your child to accept. Your child may experience many feelings over the next few days,” states the eamil. “They may feel sad, angry, confused, numb, depressed or in denial that the incident has happened. These are all natural reactions.”
The school is using its counselling centre as a drop-in area for students who may need assistance in dealing with loss.
Reports from several MBSS students were that attendance today was significantly down as many students decided not to go to school.
The school district email, which does not name the victim, does call her “a former Grade 11 student.”
A candlelight prayer service is scheduled for tonight from 8 to 9 p.m. at Emmanuel Assembly in West Kelowna (2600 Hebert Road). Everyone is welcome to attend.
One MBSS student said that, after the service, some students will be travelling to Gyro Beach in Kelowna to be together with others. Gyro was apparently one of the victim’s favourite places to be.
RCMP has not released the name of the victim. The name of the 16-year-old West Kelowna female who was arrested shortly after the Peachland stabbing likely will not be released for some time, if ever, due to restrictions under the Youth Criminal Justice Act.
